Terms and Conditions

1. General
1.1. Once you submit the completed registration form, you become a member of 24/7 Fitnesscentrum Quantum Fit. The membership applies only to the selected membership type and for the duration stated. Membership is strictly personal and transferable only with permission.

2. Terms and Conditions
2.1. The gym may amend the applicable terms. Changes take effect one calendar month after notification. If you do not accept changes, you may terminate your membership before they take effect.

3. Membership
3.1. For online registration, you have a 14-day withdrawal right without penalty. Costs for used days may be charged.
3.2. Registration may be refused without reason.
3.4. Identification may be requested at any time.
3.5. A valid phone number and email address are required.

4. Access via QR Code
4.1. After registration, you activate your account via email. The app may be installed on one phone only. A one-time fee of €42.00 applies for the app and intake. The QR code is strictly personal.
4.2. Access may be denied in case of misuse.

5. Membership Fees
5.1. Payment is made in advance via SEPA direct debit.
5.3. In case of non-payment, all remaining terms become due immediately and the QR code will be blocked.
5.4. Collection costs: 15% (minimum €40.00) plus statutory interest.
5.5. Prices may be adjusted due to VAT changes and indexed annually.

6. Privacy
6.1. Personal data is processed in accordance with the GDPR.

7. Termination or Suspension
7.1. Written cancellation required one period before contract end.
7.3. Medical termination possible with proof.
7.4. Suspension up to 6 months with medical certificate.
7.5. Contract may be terminated in case of non-payment.

8. Opening Hours
8.1. Temporary closures may occur. If closed longer than 14 days, you may cancel free of charge.

9. Complaints and Information
9.1. Changes in personal details must be reported.
9.2. Complaints should first be addressed to staff.

10. Liability
10.1. Use is at your own risk. Liability limited to insurance coverage.

11. House Rules
11.1. House rules must be observed.

12. Final Provisions
12.1. Dutch law applies. Court Noord-Nederland has exclusive jurisdiction.
12.2. Invalid provisions do not affect the remainder.

Membership-specific terms and conditions

1. General
1.1. Once you have submitted or delivered the completed registration form, you become a member of the 24/7 Fitnesscentrum Quantum Fit clubs. The membership relates only to the type of membership you have chosen with 24/7 Fitnesscentrum Quantum Fit and applies for the duration specified on the registration form. Your membership is strictly personal and may only be transferred with the permission of 24/7 Fitnesscentrum Quantum Fit.

2. Terms and Conditions
2.1. 24/7 Fitnesscentrum Quantum Fit is entitled to amend the terms and conditions applicable to the membership. 24/7 Fitnesscentrum Quantum Fit will inform you in due time. The changes take effect one calendar month after notification, unless a different statutory period is required, in which case that will apply. If you do not wish to accept a change, you may terminate your membership as of the date on which the new terms take effect. The written notice of termination must be received by 24/7 Fitnesscentrum Quantum Fit before the effective date of the change.

3. Membership
3.1. When registering online, you have the right to notify 24/7 Fitnesscentrum Quantum Fit within 14 days of the date of registration that you wish to withdraw from the membership, without penalty and without giving any reason. The method of termination is set out in Article 7 of these terms and conditions. If you decide to withdraw from the membership within the 14-day consideration period, 24/7 Fitnesscentrum Quantum Fit may charge you for the number of days you were able to use the facilities (registration fee and usage days).
3.2. 24/7 Fitnesscentrum Quantum Fit may refuse your registration at any time without giving reasons. In case of refusal, you will not incur any costs and any amounts already paid will be refunded.
3.4. 24/7 Fitnesscentrum Quantum Fit reserves the right to request identification upon registration. Furthermore, it is entitled to request identification at any time to verify that you are indeed the person using the app.
3.5. You are required to provide a valid phone number and e-mail address so that we can notify you in case of changes or payment arrears.

4. Access via QR Code through App
4.1. Upon registration, you will receive an email to activate your account and can log in to the app. This app may only be installed on one phone and must be used exclusively by you. After registration, an appointment will be scheduled for a sports intake. During the sports intake, you will receive a 24/7 induction regarding safety and sports instructions, as well as any explanation of the app and its features. You will pay a one-time fee of € 42.00 for this app + sports intake. The QR code is strictly personal. Using a 24/7 Fitnesscentrum Quantum Fit facility is only possible with the personal app.
4.2. 24/7 Fitnesscentrum Quantum Fit is authorized to deny access in case of QR code misuse.

5. Membership Fees
5.1. You must pay the membership fee in advance per period via SEPA automatic recurring debit, or if desired, for the initial contract duration (or an extension thereof). 24/7 Fitnesscentrum Quantum Fit may collect overdue payments via SEPA automatic debit.
5.2. The agreed costs for the tag + sports intake must be paid upon registration at the club via PIN, or in advance via online banking. Failure to pay these costs does not render the agreement void.
5.3. If you do not pay on time, you are automatically in default without further notice. From the date on which you are in default, all remaining membership payments become due immediately and must be paid within 30 days of becoming due to 24/7 Fitnesscentrum Quantum Fit. You cannot use the facilities of 24/7 Fitnesscentrum Quantum Fit until the arrears are cleared. Your tag will be blocked.
5.4. If 24/7 Fitnesscentrum Quantum Fit has to proceed with collection, you will owe administrative costs and (extrajudicial) collection costs equal to 15 % of the outstanding amount, with a minimum of € 50.00. From the day an amount becomes due, 24/7 Fitnesscentrum Quantum Fit may charge statutory interest.
5.5. 24/7 Fitnesscentrum Quantum Fit is entitled at all times to adjust its rates twice a year in case of changes in VAT. Furthermore, it may index the membership price once a year. If this price increase occurs within the first 3 months from the start date of the membership, you have the right to immediately terminate your membership.

6. Privacy
6.1. 24/7 Fitnesscentrum Quantum Fit processes your personal data carefully and in accordance with applicable laws and regulations, including the General Data Protection Regulation (GDPR). The Privacy Statement of 24/7 Fitnesscentrum Quantum Fit sets out which data are processed, for what purposes, and how personal data are handled. The latest version of the Privacy Statement can be found on our website.

7. Termination, Cancellation or Suspension of Membership
7.1. You may terminate the membership up to one period before the end date of the contract in writing. If you do not, the membership will automatically be extended for an indefinite period after the contract duration, with a notice period of one period.
7.2. The termination can be done via the termination form on the website. This must be filled in and sent back to ledenadministratie@quantumfit.nl

7.3. You may terminate the agreement mid-term free of charge on medical grounds, provided that a medical certificate or other reliable evidence is provided, and with due observance of a notice period of one period.
7.4. In the event of prolonged illness, injury, pregnancy or injury, the membership may be suspended temporarily—up to a maximum of 6 months—with written permission from 24/7 Fitnesscentrum Quantum Fit. Suspension is only possible upon submission of a medical certificate or other reliable proof, and never applies retroactively.
7.5. 24/7 Fitnesscentrum Quantum Fit may dissolve the agreement without notice or summons if you fail to fulfill your payment obligations (on time), if the SEPA authorization is revoked or a payment is reversed, or if you fail to comply with the rules or are denied access. Upon dissolution of the agreement, all dues for the remaining membership period become immediately payable.

8. Opening Hours
8.1. 24/7 Fitnesscentrum Quantum Fit is authorized to close clubs entirely or partially during recognized public holidays and school vacations. It is also authorized to change the opening hours of (or parts of) a club temporarily or permanently, and to close a club for repair and maintenance. If the club is unable to provide sports facilities for any reason, you agree that you may train at one of the other quantumfit clubs. If a club remains closed for more than 14 days, you may terminate the membership at no cost in accordance with Article 7.

9. Complaints and Duty to Provide Information
9.1. If the information on the registration form or later provided to 24/7 Fitnesscentrum Quantum Fit changes, you must inform 24/7 Fitnesscentrum Quantum Fit as soon as possible. If you fail to provide or delay providing these changes and 24/7 Fitnesscentrum Quantum Fit incurs costs locating the new personal data, these costs will be passed on to you.
9.2. In the event of complaints regarding 24/7 Fitnesscentrum Quantum Fit, you should initially contact the staff present in the club.

10. Liability
10.1. You are responsible for personal accidents and your personal belongings. 24/7 Fitnesscentrum Quantum Fit and/or its staff are not liable for any injury, accident, lost or stolen items of any kind and for any cause, except in the case of intent or gross negligence by 24/7 Fitnesscentrum Quantum Fit or its staff. In any case, the liability of 24/7 Fitnesscentrum Quantum Fit is limited to the maximum payout under any insurance policy taken out by 24/7 Fitnesscentrum Quantum Fit.

11. House Rules
11.1. 24/7 Fitnesscentrum Quantum Fit enforces house rules. These house rules are available in the club and may be requested at the reception of any club. You declare that you are familiar with and will comply with these house rules.

12. Final Provisions
12.1. Dutch law applies to all membership agreements concluded by 24/7 Fitnesscentrum Quantum Fit. The court in North Netherlands has exclusive jurisdiction over any disputes.
12.2. If any of the above provisions are invalid or unlawful, the remaining provisions shall remain in effect.
